Website & App Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website www.hellotech.com.au, the HelloTech customer app and the HelloTech technician app, and any related content and features (together, the “Platform”), operated by HelloTech Australia Pty Ltd (ABN 21 675 579 674). By accessing or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.

These Terms are not the service contract

These Terms govern use of the Platform itself. The supply of technology support services is governed by our separate Customer Service Agreement & Booking Terms, and (for technicians) by your Independent Contractor Services Agreement and Contractor Code of Conduct.

3. Eligibility and accounts

  • You must be at least 18 years old and able to form a legally binding contract to create an account or make a booking.
  • You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@hellotech.com.au of any unauthorised use.
  • You agree to provide accurate, current and complete information and to keep it up to date.

4. Acceptable use

You must not:

  • use the Platform for any unlawful, fraudulent or harmful purpose;
  • interfere with, disrupt, probe or attempt to gain unauthorised access to the Platform, its servers or networks;
  • introduce malware, scrape data, or use automated systems to access the Platform without our written consent;
  • impersonate any person, or misrepresent your affiliation with any person or entity;
  • post or transmit content that is defamatory, obscene, infringing, misleading or otherwise objectionable; or
  • reverse engineer, decompile or copy any part of the Platform except as permitted by law.

5. Bookings made through the Platform

Where you request a service through the Platform, you are making an offer to acquire services that is accepted in accordance with our Customer Service Agreement & Booking Terms. Prices, availability and service descriptions shown on the Platform may change before a booking is confirmed.

6. Intellectual property

All content on the Platform (including the HelloTech name and logo, the tagline “Goodbye Problems. Hello Tech.”, text, graphics, software, and design) is owned by or licensed to HelloTech and is protected by Australian and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. You must not use our trade marks or branding without our prior written consent.

7. User-submitted content

If you submit content (such as reviews, photos of devices, or support messages), you grant HelloTech a non-exclusive, royalty-free, worldwide licence to use that content to operate and promote the Services. You warrant that you own or have the rights to the content and that it does not infringe any third party’s rights. We may remove content at our discretion.

8. Third-party links and software

The Platform may link to or rely on third-party websites, products and services. We are not responsible for third-party content or practices, and your use of them is at your own risk and subject to their terms.

9. Availability and changes

We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Platform at any time, and may update these Terms by posting a revised version. Continued use after changes constitutes acceptance.

10. Disclaimers and consumer rights

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) (the “ACL”) that cannot lawfully be excluded. Subject to those rights, the Platform is provided “as is” and “as available”, and to the maximum extent permitted by law we exclude all implied warranties relating to the Platform itself.

11. Limitation of liability

To the maximum extent permitted by law, and subject to your non-excludable rights under the ACL, HelloTech is not liable for any indirect, incidental, special or consequential loss arising from your use of the Platform. Where our liability for a failure to comply with a consumer guarantee in respect of services can lawfully be limited, it is limited to resupplying the services or paying the cost of having them resupplied. Our total aggregate liability arising from your use of the Platform is otherwise limited to AUD $100 or the amount you paid us in the 12 months before the claim, whichever is greater.

12. Indemnity

You agree to indemnify HelloTech against any loss, damage or cost (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your infringement of any law or third-party right, except to the extent caused by HelloTech.

13. Termination

We may suspend or terminate your access to the Platform if you breach these Terms or if we reasonably consider it necessary to protect the Platform, our users or our business. You may stop using the Platform at any time. Clauses that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and indemnity) will survive.

14. Privacy

Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and HelloTech submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
